第一章 总 则
第一条 为了加强停车场的建设和管理,维护道路交通秩序,保障道路交通安全畅通,根据《中华人民共和国道路交通安全法》、《西安市城市道路交通管理条例》、《西安市市政工程设施管理条例》、《西安市城市规划管理办法》及有关法律、法规规定,结合本市实际,制定本办法。
第二条 本市行政区域内停车场的建设、设立及管理适用本办法。
第三条 本办法所称停车场是指供机动车停放的各种立体、地下、室内、室外的经营性停车场所和利用城市道路设置的占道停车场。
第四条 市公安交通行政管理部门是本市机动车停车场管理的主管机关。市规划行政管理部门是本市机动车停车场建设的主管机关。市政等行政管理部门按照各自的职责,配合公安、规划行政管理部门做好机动车停车场的建设、设立及管理工作。
第二章 经营性停车场的建设和占道停车场的设置
第五条 鼓励单位和个人投资建设停车场。投资建设停车场的,政府给予一定的优惠,具体优惠政策由有关部门制定,报市政府批准后施行。
第六条 市规划行政管理部门应根据城市总体规划,会同公安、市政等行政管理部门编制停车场规划。
第七条 新建、改建、扩建的大型旅馆、饭店、商店、办公楼、体育场馆、影剧院、展览馆、医院、车站、集贸市场等建筑物和公共场所,应配建相应的停车场。
第八条 建筑物配建相应停车场,应与建筑同时设计、同时建设、同时交付使用。
第九条 配建和新建停车场,须经市规划行政管理部门审核,并征得市公安交通行政管理部门同意后,方可施工。按规定应当配建停车场而没有配建的,不予核发《建设工程规划许可证》。
第十条 建设单位建设停车场确有困难,达不到规定建筑面积的,经市公安交通行政管理部门和市规划行政管理部门批准,可适当减少停车场的建筑面积,但必须按所缺机动车停车车位缴纳建设差额费。建设差额费由主管部门征收,用于公共停车场的建设,专款专用,不得挪作他用。
第十一条 经批准建设的停车场不得改变用途。因特殊原因临时改变用途的,须经市公安交通行政管理部门和市规划行政管理部门批准,并缴纳占用费。临时改变停车场用途的期限不得超过一年。
第十二条 停车场经营者应到工商行政管理部门领取营业执照后方可营业。
经营性停车场应向市公安交通行政管理部门备案。
第十三条 设置占道停车场,须经市公安交通、市政行政管理部门会同市规划行政管理部门批准,任何单位和个人不得擅自划定占道停车场。在设置有经营性停车场的区域,不得设置占道停车场。
经批准设置的非经营性占道停车场造成市政设施损坏的,按照市政设施管理规定,应当由占用者给予赔偿或修复。
第十四条 因举办大型活动需临时停车的,由市公安交通行政管理部门划定临时停车场,临时停车场不收取停车费。
第三章 停放管理
第十五条 经营性停车场要完善安全服务设施,建立安全管理制度;对出入场车辆的号牌、车型、单位及装载物等进行登记。
第十六条 经营性停车场必须设置交通标志、标线和消防器材,并按照车辆分类划分停车泊位。
占道停车场应设立明显的停车场标志,并划线、定位。
第十七条 禁止装载有易燃、易爆、剧毒、放射性等危险物品的机动车在停车场内停放。
第四章 停放收费
第十八条 停车场必须严格执行物价行政管理部门制定的统一收费标准,亮牌收费,照章纳税。
第十九条 占道停车场收取的费用为车位使用费,经营性停车场收取的费用为停放保管费。收取机动车停放保管费的经营性停车场的经营者,对所停放的车辆造成损坏或丢失的,应当予以赔偿。
车位使用费和停放保管费的收费标准,由物价行政管理部门按类别进行核定。
第二十条 停车场收费必须使用公安交通行政管理部门监制的统一票据,停车场不按照标准收费或者不使用专用票据收费的,车主有权拒交。
第二十一条 占道停车场的收费管理实行收支两条线。占道停车场的收费上缴市财政,主要用于停车场建设、市政设施维修和有关停车管理的费用。
第五章 法律责任
第二十二条 违反本办法第七条、第八条、第十条、第十一条、第十二条第一款规定的,责令改正,并处3000元以上10000元以下的罚款。
第二十三条 违反本办法第十三条规定的,责令改正,并处1000元以下的罚款。
第二十四条 违反本办法第十七条、第二十条规定的,处200元以下的罚款。
第二十五条 在机动车停车场建设和管理活动中,违反规划、市政等管理法规的,由有关部门依据有关法规予以处罚。
第二十六条 当事人对行政处罚决定不服的,可依照行政复议法和行政诉讼法申请复议或提起诉讼。逾期不申请复议或不提起诉讼又不履行处罚决定的,作出处罚决定的机关可以申请人民法院强制执行。
第六章 附 则
第二十七条 本办法自公布之日起施行。

This Ordinance may be cited as the Money Lenders Ordinance.
This Ordinance shall have effect notwithstanding any agreement

PART II LICENSING OF MONEY LENDERS

No person shall carry on business as a money lender--
without a licence;
at any place other than the premises specified in such licence;

A licence shall be in the prescribed form.

An application for a licence shall be made to the Registrar in

Where an application is lodged under section 9 (5), the

Selection of assessors and payment of fees to assessors
Where under this Ordinance the licensing court is required

关于印发阳泉市城市居民最低生活保障办法的通知
各县(区)人民政府,市直各单位,省营以上企业:
现将《阳泉市城市居民最低生活保障办法》印发给你们,请
认真遵照执行。

阳泉市城市居民最低生活保障办法
第一章 总 则
第一条 为保障我市城市困难居民基本生活,进一步完善和
规范社会保障制度,根据国务院《城市居民最低生活保障条例》
和山西省人民政府《关于进一步加强城市居民最低生活保障工作
的意见》(晋政发[2001]4号)以及《阳泉市完善城镇社会保障体
系试点实施方案》,特制定本办法。
第二条 城市居民最低生活保障,是指持有阳泉市非农业户
口的城市居民基本生活所必需的衣、食、住,并适当考虑水、电、
燃煤(燃气)及未成年人义务教育费用,由市人民政府确定标准
并提供的最低物质需要的帮助。
城市居民最低生活保障标准为市区每人每月143元。农业县
(区)城镇人口最低生活保障标准,由各县(区)人民政府确定,
并报市民政局备案。
城市居民最低生活保障标准应根据经济发展及物价变动等情
况,适时调整。
第三条 实施城市居民最低生活保障制度所需资金,按照保
障对象的范围,在中央和省补助资金的基础上,市、城矿两区原
则上按各50%的比例分担,郊区、平定县、盂县市级财政酌情
给予补助。所需资金各级财政要列入预算,纳入社会救济专项资
金科目,专帐管理,按季度列支。低保工作所需经费,各级财政
要足额纳入预算。
第四条 民政部门是城市居民最低生活保障工作的行政主管
部门。街道办事处、社区居民委员会是实施城市居民最低生活保
障制度的基层工作机构,负责低保工作的管理、审核、服务工作。
市、县(区)民政局下设城市居民最低生活保障管理中心,街道
办事处要设立城市居民最低生活保障管理服务站。
第五条 城市居民最低生活保障,坚持国家保障与社会帮扶
相结合,鼓励自救,在完善城市居民最低生活保障制度的同时,
健全临时救济、政策扶持、社会互助和家庭保障等配套措施。
第二章 保障对象的确定和家庭收入、保障金的计算
第六条 城市居民最低生活保障,实行属地管理原则,凡持
有本辖区非农业户口,家庭月人均收入低于城市最低生活保障标
准的居民纳入城市最低生活保障范围。
1、无生活来源、无劳动能力又无法定赡养人、扶养人或者
抚养人,以及虽有法定赡养人、扶养人或抚养人,但无赡养、扶
养或抚养能力的城市居民;
2、在职人员领取最低工资及离退休人员领取离退休费后,
家庭月人均收入仍低于城市居民最低生活保障标准的城市居民;
3、下岗职工进入再就业服务中心期间,足额领取基本生活
费后家庭月人均收入仍低于城市居民最低生活保障标准的城市居
民;
4、失业人员领取失业保险金期满后未能就业,家庭月人均
收入仍低于城市居民最低生活保障标准的城市居民;
5、未参加过基本养老保险统筹,且已经没有生产经营能力,
无力缴纳养老保险费的城镇集体企业中的退休人员可直接进入最
低生活保障范围;
6、月人均收入不达城市居民最低生活保障标准的其它城市
居民。
第七条 保障对象家庭成员的确定。法定夫妻双方及其未婚
子女视为同一家庭成员。未经法律程序解除婚姻或抚养关系,虽
不在一处生活的应视为同一家庭成员;未经法律程序认定婚姻或
抚养关系,虽在一起生活的不能视为同一家庭成员。
第八条 保障对象的家庭收入确定范围:
1.各类工资、奖金、津贴、物价补贴及其它收入;
2.离退休人员、下岗、失业人员领取的养老保险金、基本生
活费、失业救济金;
3、家庭成员通过个体经营、外出打工获得的所有收入;
4、家庭成员继承的财产和接受的赠予;
5、法定赡养人、扶养人或抚养人,应当给付的赡养、扶养
或抚养费;
6、出租或者变卖家庭资产获得的收入;
7、储蓄存款、股票等有价证券及孳息收入;
8、其它收入。
第九条 有下列情形之一的,不计入共同生活家庭成员的收
入:
1、为国家、社会和人民做出特殊贡献,政府给予的奖励金
及市级以上劳动模范退休后享受的荣誉津贴;
2、优抚对象享受的抚恤金、补助金;
3、为解决在校学生就学困难,由政府和社会给予的补助金;
4、因工(公)负伤职工的护理费以及死亡职工的亲属享受
的一次性抚恤金;
5、按规定由在职人员所在单位代缴的住房公积金和各项社
会保险统筹费。
第十条 非农业人口与农业人口混合的家庭,月人均收入应
合并计算,分别按户口类型,享受城市和农村的补助标准。
第十一条 赡养、扶养、抚养费的计算。构成赡养、扶养、
抚养关系的义务人,应依法承担赡养、扶养或抚养责任,在保证
其家庭正常生活水平的前提下,应适当计算其赡养费、扶养费或
抚养费。
第十二条 家庭领取保障金的计算办法。家庭月领取保障金
=(最低生活保障标准-家庭人均月收入)×家庭人口。
第三章 保障金的申请、审批和发放程序
第十三条 保障金审批程序。
(一)由户主向户口所在地社区居民委员会提出书面申请并
提供以下证明:
1.家庭中在职人员所在单位出具的收入证明;
2.赡养义务人家庭收入状况证明;
3.抚养义务人收入证明;
4.其它有关证明材料(如户口簿、身份证、结婚证、残疾证、
离退休证等)。
(二)申请人如实填写《阳泉市城市居民最低生活保障金待
遇申请表》一式三份。
(三)社区居民委员会对申请人家庭成员收入情况调查核实
后,加注意见,将申请表及各种证明材料上报街道办事处审核。
对于较难认定的申请人,要由社区居民委员会评议小组评议认可
后上报街道办事处。
(四)街道办事处对社区居民委员会上报的各种材料审核
后,加注意见,上报县(区)民政局审批。
(五)县(区)民政局对街道办事处上报的材料审批后,将
申请审核书、表及证明材料存档。申请表分别由县(区)民政局、
街道办事处、社区居民委员会保存备查。
(六)对符合享受城市居民最低生活保障待遇的家庭,民政
部门应当自书面申请和应提交的证明材料齐备之日起30日内办
结审批手续,对不符合条件的30日内下发通知,并说明不予批
准的理由。
第十四条 保障金的发放。保障金的发放由街道办事处统一
组织。保障金每月定期发放一次。发放前,街道办事处要依据县
(区)民政局审批结果填好《阳泉市城市居民领取最低生活保障
金花名册》,并发给保障金领取证。发放时,保障对象持户口簿、
领取证、身份证在规定时间内到街道办事处领取保障金。承办人
在保障对象领取证上签字(盖章),保障对象在花名册上签字(盖
章)。各项制度逐步完善后,保障金的发放要向规范化、社会化
过渡。
第四章 管理监督与处罚
第十五条 保障金的审批发放实行县(区)、街道办事处(乡、
镇人民政府)和社区居民委员会三级负责制,坚持政策公开、对
象公开、金额公开的原则,实行初审、发放两榜公布。
第十六条 申请人应当如实反映家庭成员及家庭所有的经济
收入情况,不得隐瞒不报或少报,不得冒领保障金。
县(区)民政部门、街道办事处(乡、镇人民政府)和社区
居民委员会对申领最低生活保障金的对象应认真审核,严格把
关,及时足额将保障金发放到保障对象手中。
第十七条 管理审批机关为审批城市居民最低生活保障待遇
的需要,可以通过入户调查、邻里访问以及信函索证等方式对申
请人的家庭经济状况和实际生活水平进行调查核实。申请人及有
关单位、组织或者个人应当接受调查,如实提供有关情况。
第十八条 在就业年龄内有劳动能力但尚未就业的城市居
民,在享受城市居民最低生活保障待遇期间,应当参加其所在社
区居民委员会组织的公益性社区服务劳动。
第十九条 无生活来源、无劳动能力、无法定赡养人、扶养
人、抚养人的城市居民领取保障金满一年,其他保障对象领取保
障金满三个月,由户主向户籍所在地社区居民委员会提出复核申
请,填写《阳泉市城市居民领取最低生活保障金复核表》,逐级
上报复核。对保障金额需要变更的,换发新的领取证,对停领的
收回领取证。保障对象无故不填写“复核表”,取消其享受保障
资格,并收回其领取证。
第二十条 档案管理与统计报表。档案管理实行常规档案、
微机档案双重管理制度。常规档案主要包括申请、证明、审批表
等材料。同时建立数据库,统计报表实行微机联网上报。
第二十一条 财政、审计部门要严格依法对城市居民最低生
活保障资金使用管理情况进行监督检查。
第二十二条 从事城市居民最低生活保障管理审批工作的人
员有下列行为之一的,视情节轻重给予批评教育或行政处分,构
成犯罪的,依法追究刑事责任。
(一)对符合享受城市居民最低生活保障待遇条件的家庭,
拒不签署同意享受城市居民最低生活保障待遇意见,或者对不符
合享受城市居民最低生活保障待遇条件的家庭,故意签署同意享
受城市居民最低生活保障待遇意见的;
(二)玩忽职守、徇私舞弊,贪污、挪用、扣压、拖欠城市
居民最低生活保障金的。
第二十三条 城市居民最低生活保障工作实行动态管理,对
享受城市居民最低生活保障待遇的城市居民,有下列行为之一
的,由县(区)民政部门给予批评教育或者警告,追回其冒领的
城市居民最低生活保障金。情节恶劣的,处冒领金额1至3倍的
罚款:
(一)采取虚报、隐瞒、伪造等手段,骗取享受城市居民最
低生活保障待遇的;
(二)在享受城市居民最低生活保障待遇期间家庭收入情况
好转,不按规定告知管理审批机关,继续享受城市居民最低生活
保障待遇的。
第二十四条 城市居民对县(区)民政部门作出的不批准享
受城市居民最低生活保障待遇或者减发、停发城市居民最低生活
保障金的决定或给予的行政处罚不服的,可以依法申请行政复
议;对复议仍不服的,可以依法提起行政诉讼。
第五章 附 则
第二十五条 教育、粮食、自来水、电力、卫生、建设等部
门要积极主动为保障对象制定相应的优惠政策,以确保城市低收
入居民的基本生活。
第二十六条 平定县、盂县、郊区应参照本办法修订本地区
城镇居民最低生活保障制度。
第二十七条 本办法由市民政局负责解释。
第二十八条 本办法自二ΟΟ一年十月一日起施行。一九
九七年十二月二十六日颁布的《阳泉市城市居民最低生活保障制
度暂行办法》及《阳泉市城市居民最低生活保障制度暂行办法实
施细则》同时废止。
